Abstract

Systems and method to identify and locate probate estates of client debtors. One embodiment includes receiving a client file, wherein the file includes a record of individual client debtors and determining if a date of death is available for each of the individual client debtors. Some such embodiments further include identifying one or more courts in which to search for a probate estate for each of the individual client debtors and searching for a probate estate in each identified court for each respective client debtor. In some embodiments, if a probate estate is not identified for a client debtor, the client debtor is placed in a queue, and the search is performed on a recurring or periodic basis until the probate estate is located or a certain period of time has passed.

Claims (44)

1. A method comprising:

receiving a client file into a computer, the file including a record of at least one individual client debtor;

processing the client file on a processor of the computer to identify at least one court in which to search for a probate estate for the at least one individual client debtor;

searching for a probate estate in court data for the at least one identified court for each of the at least one individual client debtor; and

placing a client debtor in a holding queue when a probate estate is not identified for the client debtor, wherein the searching for a probate estate is performed on a recurring basis for each client debtor in the holding queue, wherein a client debtor remains in the holding queue for a period, after which when a probate estate is not identified for the client debtor, the client debtor is removed from the holding queue.

2. The method of claim 1 , comprising:

generating a claim form for a probate estate found for a client debtor; and

submitting the claim form to the identified court in which the probate estate exists.

3. The method of claim 2 , wherein a claim form is generated for a client debtor only if a time to file a claim has not expired.

4. The method of claim 1 , wherein the recurring basis is a weekly basis.

5. The method of claim 1 , wherein the period of time that a client debtor remains in the holding queue is one year.

6. A system comprising:

a processor;

a memory device;

a court database;

a client debtor database; and

software held in the memory device that executes on the processor to cause the system to:

process client debtor data from the client debtor database to determine if a client debtor is deceased;

identify a court represented in the court database in which a probate estate exists for the client debtor;

update the client debtor data in the client debtor database to include the identified court from the court database;

generate a claim against the probate estate of the client debtor on behalf of the client; and

place the client debtor in a holding queue when a probate estate is not located for the client debtor in the court database, wherein a client debtor remains in the holding queue for a period, after which when a probate estate is not identified for the client debtor, the client debtor is removed from the holding queue.

7. The system of claim 6 , wherein client debtor database includes a record for each client debtor, and further wherein each client debtor record includes:

a social security number field;

one or more name fields;

a street address field;

a city field;

a state field;

a zip code field;

a date of death field; and

a court field.

8. The system of claim 7 , wherein the court database includes a court table, wherein the court table is a lookup table to identify a court having probate jurisdiction based on a one-to-one relationship between a city, state, zip code combination and a court.

9. The system of claim 8 , wherein client debtor database is a relational database and a client debtor record includes data stored in two or more tables relationally linked within the relational database.

10. The system of claim 6 , wherein the software further executes on the system to extract client debtor data from a file into the client debtor database.

11. A method comprising:

processing, on a processor of a computer, debtor data that includes debtor identifying data of at least one debtor, the processing performed to identify at least one court in which to search for a probate estate for the at least one debtor; and

searching for a probate estate in court data for the at least one identified court for each of the at least one debtor;

placing a debtor in a holding queue when a probate estate is not identified for the debtor, wherein the searching for a probate estate is performed on a recurring basis for each debtor in the holding queue, wherein a debtor remains in the holding queue for a period, after which when a probate estate is not identified for the debtor, the debtor is removed from the holding queue.

12. The method of claim 11 , comprising:

generating a claim form for a probate estate found for a debtor; and

submitting the claim form to the identified court in which the probate estate exists.

13. The method of claim 12 , wherein a claim form is generated for a debtor only if a time to file a claim has not expired.

14. The method of claim 11 , wherein the recurring basis is a weekly basis.

15. The method of claim 11 , wherein the period of time that a debtor remains in the holding queue is one year.
