Signed Petition from the Attorney of Record
The petition must be signed by the attorney of record for the application. It should identify the invention, all inventors, and the foreign country in which filing is intended. Download petition template →

A complete copy of the patent application intended for foreign filing must accompany the petition for review by the USPTO's Licensing & Review branch.

Foreign Filing Licenses

A foreign filing license is authorization from the USPTO that permits the filing of a patent application in a foreign country. Under U.S. law, inventions made in the United States generally require a foreign filing license before a patent application can be filed abroad.

You need a foreign filing license when filing a patent application in a foreign country for an invention that was made in the United States. A license is automatically granted 6 months after the U.S. filing date if no secrecy order has been issued. If you need to file abroad before that 6-month window, you'll need to request an expedited foreign filing license.

Expedited requests are typically handled within 3 business days. We submit the request to the USPTO on your behalf and email you a scanned copy of the granted license as soon as it's available.

Our $200 fee covers submitting the request for an expedited foreign filing license with the USPTO and emailing a scanned copy of the granted license to you. It does not include the USPTO government fee ($235) or printing charges.
