Abstract

Systems, methods, and graphical user interfaces for the management and coordination of patent infringement-related analyses, such as freedom-to-operate, patent clearance, and enforcement, are provided. Patent claim information is extracted and presented to users along with purpose-specific workflows that facilitate the capture and presentation of work product on both a claim-by-claim level as well as on a document level. Integrated data management facilitates access to historical work product by interconnecting the various record entities of the system including product information, patent document information, review information, and work product information.

Claims (52)

1. A computer-implemented method of managing patent analysis comprising the steps of:

(a) storing a first review, in response to one or more user inputs, that contains a first patent document identifier, wherein the first review is a collection of stored data comprising (i) a first review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the first review;

(b) displaying a user-engageable first patent review interface, the first patent review interface including information associated with the first patent document identifier within the context of the first review, the display including: (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

(c) receiving a first input from a user that represents analysis performed in association with the first patent document identifier in the context of the first review;

(d) storing first work product data in response to the received first input, the first work product data being stored in connection with the first patent document identifier and in connection with the first review;

(e) storing a second review, in response to one or more user inputs, that also contains the first patent document identifier, wherein the second review is a collection of stored data comprising (i) a second review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the second review;

(f) displaying a user-engageable second patent review interface, the second patent review interface including information associated with the first patent document identifier within the context of the second review, the display including at least (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

(g) receiving a second input from a user that represents analysis performed with respect to the first patent document identifier in the context of the second review;

(h) storing second work product data in response to the received second input, the second work product data being stored in connection with the first patent document identifier and in connection with the second review;

wherein the second patent review interface further includes a review history indicator, the review history indicator indicating whether the first patent document identifier is contained in at least one review other than the second review; the method further comprising the step of:

(i) displaying the first work product data in response to one or more user inputs representing a selection in association with the review history indicator, thereby presenting to the user work product that has been stored in connection with the first patent document identifier in the context of the first review.

2. The computer-implemented method of claim 1 , wherein the displayed first work product comprises a user-provided determination in relation to at least one published claim of the patent document that is represented by the first patent document identifier.

The computer-implemented method of claim 2 , wherein the displayed first work product comprises a plurality of determinations, the plurality of determinations being correlated on a claim-by-claim basis with a plurality of the published claims of the patent document that is represented by the first patent document identifier.

4. The computer-implemented method of claim 1 , wherein the displayed first work product comprises a textual comment that was provided by a user in relation to the first patent document identifier in the context of the first review.

5. The computer-implemented method of claim 1 , wherein the displayed first work product comprises a portion of claim text that has been selected and highlighted by a user in the context of the first review.

6. The computer-implemented method of claim 1 , further comprising the steps of:

querying a database that contains a plurality of stored reviews, each having a unique review identifier, to determine all reviews stored in the database that meet both of the following conditions: (i) the review contains the first patent document identifier, and (ii) the user has access to the review; and

displaying, in response to one or more user inputs representing a selection in association with the review history indicator in the second patent review interface, a listing of all stored reviews that are responsive to the querying step.

7. A program stored on a non-transitory computer-readable medium that when executed by a computing device performs a method comprising the steps of:

(a) storing a first review, in response to one or more user inputs, that contains a first patent document identifier, wherein the first review is a collection of stored data comprising (i) a first review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the first review;

(b) displaying a user-engageable first patent review interface, the first patent review interface including information associated with the first patent document identifier within the context of the first review, the display including: (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

(c) receiving a first input from a user that represents analysis performed in association with the first patent document identifier in the context of the first review;

(d) storing first work product data in response to the received first input, the first work product data being stored in connection with the first patent document identifier and in connection with the first review;

(e) storing a second review, in response to one or more user inputs, that also contains the first patent document identifier, wherein the second review is a collection of stored data comprising (i) a second review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the second review;

(f) displaying a user-engageable second patent review interface, the second patent review interface including information associated with the first patent document identifier within the context of the second review, the display including at least (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

(g) receiving a second input from a user that represents analysis performed with respect to the first patent document identifier in the context of the second review;

(h) storing second work product data in response to the received second input, the second work product data being stored in connection with the first patent document identifier and in connection with the second review;

wherein the second patent review interface further includes a review history indicator, the review history indicator indicating whether the first patent document identifier is contained in at least one review other than the second review; the method further comprising the step of:

(j) displaying the first work product data in response to one or more user inputs representing a selection in association with the review history indicator, thereby presenting to the user work product that has been stored in connection with the first patent document identifier in the context of the first review.

8. The program of claim 7 , wherein the displayed first work product comprises a user-provided determination in relation to at least one published claim of the patent document that is represented by the first patent document identifier.

The program of claim 8 , wherein the displayed first work product comprises a plurality of determinations, the plurality of determinations being correlated on a claim-by-claim basis with a plurality of the published claims of the patent document that is represented by the first patent document identifier.

10. The program of claim 7 , wherein the displayed first work product comprises a textual comment that was provided by a user in relation to the first patent document identifier in the context of the first review.

11. The program of claim 7 , wherein the displayed first work product comprises a portion of claim text that has been selected and highlighted by a user in the context of the first review.

12. The program of claim 7 , further comprising the steps of:

querying a database that contains a plurality of stored reviews, each having a unique review identifier, to determine all reviews stored in the database that meet both of the following conditions: (i) the review contains the first patent document identifier, and (ii) the user has access to the review; and

displaying, in response to one or more user inputs representing a selection in association with the review history indicator in the second patent review interface, a listing of all stored reviews that are responsive to the querying step.

13. A system comprising one or more processors configured to control:

(a) a storage module configured to store a first review, in response to one or more user inputs, that contains a first patent document identifier, wherein the first review is a collection of stored data comprising (i) a first review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the first review;

(b) a display module configured to display a user-engageable first patent review interface, the first patent review interface including information associated with the first patent document identifier within the context of the first review, the display including: (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

(c) a user input module configured to receive a first input from a user that represents analysis performed in association with the first patent document identifier in the context of the first review, the storage module being further configured to store first work product data in response to the received first input, the first work product data being stored in connection with the first patent document identifier and in connection with the first review;

wherein the storage module is further configured to store a second review, in response to one or more user inputs, that also contains the first patent document identifier, wherein the second review is a collection of stored data comprising (i) a second review identifier, (ii) a plurality of patent document identifiers including at least the first patent document identifier, and (iii) user-provided work product that represents analysis performed with respect to particular patent documents represented by the plurality of patent document identifiers contained in the second review;

wherein the display module is further configured to display a user-engageable second patent review interface, the second patent review interface including information associated with the first patent document identifier within the context of the second review, the display including at least (i) a publication number associated with the first patent document identifier, (ii) text from at least a portion of published claims associated with the first patent document identifier, and (iii) a work-product capture area configured to receive a user input representing analysis associated with the first patent document identifier;

wherein the user input module is further configured to receive a second input from a user that represents analysis performed with respect to the first patent document identifier in the context of the second review, the storage module being further configured to store second work product data in response to the received second input, the second work product data being stored in connection with the first patent document identifier and in connection with the second review;

wherein the second patent review interface further includes a review history indicator, the review history indicator indicating whether the first patent document identifier is contained in at least one review other than the second review; and

wherein the display module is further configured to display the first work product data in response to one or more user inputs representing a selection in association with the review history indicator, thereby presenting to the user work product that has been stored in connection with the first patent document identifier in the context of the first review.

14. The system of claim 13 , wherein the displayed first work product comprises a user-provided determination in relation to at least one published claim of the patent document that is represented by the first patent document identifier.

The system of claim 14 , wherein the displayed first work product comprises a plurality of determinations, the plurality of determinations being correlated on a claim-by-claim basis with a plurality of the published claims of the patent document that is represented by the first patent document identifier.

16. The system of claim 13 , wherein the displayed first work product comprises a textual comment that was provided by a user in relation to the first patent document identifier in the context of the first review.

17. The system of claim 13 , wherein the displayed first work product comprises a portion of claim text that has been selected and highlighted by a user in the context of the first review.

18. The system of claim 13 , further comprising the steps of:

querying a database that contains a plurality of stored reviews, each having a unique review identifier, to determine all reviews stored in the database that meet both of the following conditions: (i) the review contains the first patent document identifier, and (ii) the user has access to the review; and

displaying, in response to one or more user inputs representing a selection in association with the review history indicator in the second patent review interface, a listing of all stored reviews that are responsive to the querying step.
