Practitioners often assume every Gulf filing means consular legalization — and for Kuwait and Qatar, it does. Oman is the pleasant exception: the Hague Apostille Convention entered into force for the Sultanate on January 30, 2012, so a U.S. document with an apostille is accepted directly. No embassy leg, no consular fees.

What This Means for IP Filings

For powers of attorney, assignments, priority documents, and corporate resolutions destined for Oman's Ministry of Commerce, Industry and Investment Promotion — which houses the Sultanate's intellectual property department — a single apostille from the competent U.S. authority is all the authentication Oman requires.

What an Apostille Covers — and What It Doesn't

  • Private documents are notarized first. A power of attorney or assignment generally has to be notarized before it can be apostilled.
  • Arabic translation requirements remain. The apostille authenticates the document's origin; it doesn't satisfy any translation requirement your Omani associate specifies.
  • The underlying document still has to be right. An apostille won't fix a document that wasn't drafted to your associate's specifications.

The Process

  1. Notarize the document (for private documents such as POAs and assignments). Use the correct notary statement for the state where the document is signed and executed — you can view and download the right one here.
  2. Obtain the apostille — from the Secretary of State for state-level documents, or the U.S. Department of State for federal documents such as USPTO certified copies.
  3. Arrange any required Arabic translation per your associate's instructions.
