Saudi Arabia has historically been one of the more involved destinations for document legalization, requiring a full consular chain that ended at a Saudi embassy or consulate. That changed on December 7, 2022, when the Hague Apostille Convention entered into force for the Kingdom. For most documents, a single apostille now replaces the entire consular legalization process.
What Changed
Previously, a U.S.-issued document going to Saudi Arabia had to be notarized, authenticated at the state and federal level, and then legalized by a Saudi consulate. Now, because both the United States and Saudi Arabia are members of the Apostille Convention, a document apostilled by the competent U.S. authority is recognized directly in Saudi Arabia — no consular step required.
For IP filings, that applies to the documents you deal with most often: powers of attorney, assignments, priority documents, and corporate resolutions destined for the Saudi Authority for Intellectual Property (SAIP).
What an Apostille Does — and Doesn't — Do
The apostille streamlines authentication, but it doesn't remove the other requirements that still apply:
- Notarization still comes first for private documents. A power of attorney or assignment generally must be notarized before it can be apostilled.
- Arabic translation requirements remain. The apostille authenticates the document's origin; it does not satisfy any translation requirement imposed by SAIP or your local associate.
- The underlying document still has to be right. An apostille won't fix a document that wasn't drafted to your associate's specifications.
The Process Today
- Notarize the document (for private documents such as POAs and assignments). Use the correct notary statement for the state where the document is signed and executed — you can view and download the right one here.
- Obtain the apostille — from the Secretary of State for state-level documents, or the U.S. Department of State for federal documents.
- Arrange any required Arabic translation per your associate's instructions.
