Abstract

A method of and system for handling latency issues encountered in producing real-time entertainment such as games of skill synchronized with live or taped televised events is described herein. There are multiple situations that are dealt with regarding latencies in receiving a television signal with respect to real-time entertainment based on the unfolding games played along with the telecasts. Systemic delays, arbitrarily imposed delays of a broadcast signal and variances in the precise broadcast times of taped television programs have to be equalized so as to provide fair entertainment.

Claims (94)

1. A system for equalizing effects of latency issues for a game of skill or chance or entertainment comprising:

a. a mobile device; and

b. a server coupled to the mobile device wherein the server sends a lockout signal at an appropriate time based on a measured amount of delay to prevent a user from submitting a response after receipt of a game event in a television broadcast.

2. The system as claimed in claim 1 wherein the mobile device is within a group of mobile devices.

3. The system as claimed in claim 1 wherein the server determines which group the mobile device is in.

4. The system as claimed in claim 1 wherein the server stores game control data and transmits the game control data to the mobile device.

5. The system as claimed in claim 4 wherein the game control data includes delay information for implementing the lockout signal.

6. The system as claimed in claim 1 wherein the server contains a location determination application for determining the location of the mobile device.

7. The system as claimed in claim 1 wherein the mobile device contains a location determination application for determining the location of the mobile device.

8. The system as claimed in claim 1 wherein variances in delays in receiving the television signal determine delays in transmitting applicable data files within a television signal reception path.

9. The system of claim 1 wherein the television broadcast comprises commercials.

10. The system of claim 9 wherein questions to be displayed at precise times before, during and after the commercials sent to the mobile device in synchronization with the television broadcast.

11. The system of claim 10 wherein an incentive is awarded for answering the questions on the mobile device in synchronization with the television broadcast of the commercials.

12. The system of claim 1 wherein events in the television broadcast are used as synchronization points and as start points for previously downloaded data files to a mobile client.

13. The system of claim 1 wherein a synchronization point is a visible or audible event located within the television broadcast.

14. The system of claim 1 wherein information is inserted in a Vertical Blanking Interval (VBI) or equivalent of the television broadcast and tracked online in real-time.

15. The system of 1 wherein information is embedded in the television broadcast and tracked online in real-time.

16. The system of claim 1 wherein a start time of a commercial is delivered using a recognizable signal recognizable by the mobile device.

17. The system of claim 1 wherein a game of skill or chance or entertainment is run in conjunction with the television broadcast and wherein the game of skill or chance or entertainment comprises pre-produced data files.

18. The system of claim 17 wherein the pre-produced data files comprise real-time entertainment.

19. The system of claim 17 wherein a plurality of synchronization points are used by a client to continuously check to ensure the pre-produced data files are synchronized with the television broadcast.

20. The system of claim 17 wherein inserted audio or video in the television broadcast is used to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the television broadcast.

21. The system of claim 20 wherein the inserted audio or video is used by a client to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the tarred television broadcast.

22. The system of claim 20 wherein the inserted audio or video is used by a server to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the television broadcast.

23. The system of claim 1 wherein an artifact is inserted into the television broadcast recognizable by an audio receiver in a mobile device which is utilized to start and continually keep a game of skill or chance or entertainment synchronized with the television broadcast.

24. The system of claim 1 wherein the game of skill or chance ends when the television broadcast ends.

25. The system of claim 1 wherein a server sends the game of skill or chance or entertainment to the mobile device.

26. The system of claim 1 wherein the game of skill or chance or entertainment is stored in a memory of the mobile device.

27. The system of claim 1 wherein the game of skill or chance or entertainment is stored in random access memory of the mobile device.

28. The system of claim 1 wherein the game of skill or chance or entertainment is displayed on the mobile device.

29. The system of claim 1 wherein an earliest receipt of a lockout signal by participants is utilized for equalizing locking out all participants receiving the television broadcast later.

30. The system of claim 1 wherein a delay is established by comparing audio or video samples derived from the mobile device linked to a game server by comparing samples to audio or video files of the television broadcast.

31. The system of claim 30 wherein adjustment of the amount of delay results in synchronization of receipt of a television signal of the television broadcast and presentation of game-related data on the mobile device.

32. The system of claim 1 wherein a shortest delay experienced by participants is determined and applying lockouts to the participants based on the shortest delay.

33. The system of claim 1 wherein participants comprise ad hoc or preexisting groups of friends competing in a separate competition in disparate physical locations.

34. The system of claim 1 wherein the synchronization points are the audio or video data for the television broadcast residing on the server online with the mobile device.

35. The system of claim 1 wherein participants constitute ad hoc or existing groups of geographically dispersed friends participating in a separate game of chance or skill or entertainment.

36. The system of claim 35 wherein the participants are ad hoc or previously organized groups of friends competing against each other in a separate contest.

37. The system of claim 36 wherein equalizing the participants comprises time stamping an amount of delay on game-related data.

38. The system of claim 1 wherein the television broadcast is stored on a digital video recorder.

39. The system of claim 1 wherein it is determined if there is additional processing of the television broadcast increasing a total length of delay.

40. The system of claim 1 wherein a delay includes a digital video recorder delay wherein the television broadcast is recorded on the digital video recorder.

41. The system of claim 1 wherein a delay is equalized by incorporating time stamping the amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time where client software delays presentation of game data based on a precise viewing time of the television broadcast.

42. The system of claim 1 wherein a client used in connection with viewing the television broadcast utilizes automatic content recognition to synchronize preproduced game data files to precisely synchronize game data files with the television broadcast.

43. The system of claim 1 wherein the server comprises an automated system for establishing an amount of delay, which samples an audio track of a satellite or over the air broadcast signal, to provide information related to a precise arrival of the television broadcast.

44. The system of claim 1 wherein the television broadcast is recorded on a digital video recorder.

45. The system of claim 1 wherein a set of cohorts is equalized by time stamping an amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time relative to receipt of the broadcast, where client software delays presentation of game data based on a precise time of reception of the broadcast by a group.

46. The system of claim 1 wherein the television broadcast and the set of files are presented on a same screen.

47. The system of claim 1 wherein the television broadcast and the set of files are presented on different screens.

48. The system of claim 1 wherein electronics receiving and displaying the television broadcast on a first screen coupled to a game server via the Internet provide control information to a second screen.

49. A method of equalizing effects of latency issues for a game of skill or chance or entertainment comprising:

a. determining when to send a lockout signal comprising a time value relating to a game event within a contest; and

b. sending the lockout signal from a server to a mobile device based on a measured amount of delay to prevent scoring of a response entered after the time value.

50. The method of claim 49 wherein the game event is included within a television broadcast.

51. The method of claim 50 wherein the television broadcast comprises commercials.

52. The method of claim 51 wherein questions to be displayed at precise times before, during and after the commercials are sent to the mobile device in synchronization with the television broadcast.

53. The method of claim 52 wherein an incentive is awarded for answering the questions on the mobile device in synchronization with the television broadcast of the commercials.

54. The method of claim 50 wherein existing events in the television broadcast are used as synchronization points and as start points for previously downloaded data files to a mobile client.

55. The method of claim 50 wherein a synchronization point is a visible or audible event located within the television broadcast.

56. The method of claim 50 wherein information is inserted in a Vertical Blanking Interval (VBI) or equivalent of the television broadcast and tracked online in real-time.

57. The method of claim 50 wherein information is embedded in the television broadcast and tracked online in real-time.

58. The method of claim 50 further comprising determining one or more start times of the television broadcast including using a recognizable signal recognizable by the mobile device.

59. The method of claim 50 further comprising delivering a start time of a commercial using a recognizable signal recognizable by the mobile device.

60. The method of claim 50 wherein a game of skill or chance or entertainment is run in conjunction with the television broadcast and wherein the game of skill or chance or entertainment comprises pre-produced data files.

61. The method of claim 60 wherein the pre-produced data files comprise real-time entertainment.

62. The method of claim 60 wherein a plurality of synchronization points are used by a client to continuously check to ensure the pre-produced data files are synchronized with the television broadcast.

63. The method of claim 60 wherein inserted audio or video in the television broadcast is used to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the television broadcast.

64. The method of claim 63 wherein the inserted audio or video is used by a client to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the television broadcast.

65. The method of claim 63 wherein the inserted audio or video is used by a server to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the television broadcast.

66. The method of claim 50 wherein an artifact is inserted into the television broadcast recognizable by an audio receiver in a mobile device which is utilized to start and continually keep a game of skill or chance or entertainment synchronized with the television broadcast.

67. The method of claim 50 wherein the game of skill or chance ends when the television broadcast ends.

68. The method of claim 49 wherein a server sends the game of skill or chance or entertainment to the mobile device.

69. The method of claim 49 wherein the game of skill or chance or entertainment is stored in a memory of the mobile device.

70. The method of claim 49 wherein the game of skill or chance or entertainment is stored in random access memory of the mobile device.

71. The method of claim 49 further comprising displaying the game of skill or chance or entertainment on the mobile device.

72. The method of claim 50 wherein an earliest receipt of a lockout signal by participants is utilized for equalizing locking out all participants receiving the television broadcast later.

73. The method of claim 50 further comprising establishing a delay by comparing audio or video samples derived from the mobile device linked to a game server by comparing samples to audio or video files of the television broadcast.

74. The method of claim 49 wherein adjustment of the amount of delay results in synchronization of receipt of a television signal of the television broadcast and presentation of game-related data on the mobile device.

75. The method of claim 49 further comprising determining a shortest delay experienced by participants and applying lockouts to the participants based on the shortest delay.

76. The method of claim 49 wherein participants comprise ad hoc or preexisting groups of friends competing in a separate competition in disparate physical locations.

77. The method of claim 49 wherein participants constitute ad hoc or existing groups of geographically dispersed friends participating in a separate game of chance or skill or entertainment.

78. The method of claim 77 wherein the participants are ad hoc or previously organized groups of friends competing against each other in a separate contest.

79. The method of claim 78 wherein equalizing the participants comprises time stamping an amount of delay on game-related data.

80. The method of claim 50 wherein the television broadcast is stored on a digital video recorder.

81. The method of claim 50 further comprising determining if there is additional processing of the television broadcast increasing a total length of delay.

82. The method of claim 50 wherein a delay includes a digital video recorder delay wherein the television broadcast is recorded on the digital video recorder.

83. The method of claim 50 further comprising equalizing a delay wherein equalizing incorporates time stamping the amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time where client software delays presentation of game data based on a precise viewing time of the television broadcast.

84. The method of claim 50 wherein a client used in connection with viewing a time shifted telecast of a previously recorded program utilizes automatic content recognition to synchronize preproduced game data files to precisely synchronize game data files with the recorded program.

85. The method of claim 50 wherein a client used in connection with viewing a delayed program utilizes automatic content recognition to synchronize preproduced game data files to precisely synchronize game data files with the recorded television broadcast.

86. The method of claim 50 wherein determining comprises establishing an amount of delay through an automated system linked to a server, which samples an audio track of a satellite or over the air broadcast signal, to provide information related to a precise arrival of the television broadcast.

87. The method of claim 50 further comprising equalizing a set of cohorts comprising time stamping an amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time relative to receipt of the television broadcast, where client software delays presentation of game data based on a precise time of reception of the television broadcast by a group.

88. The method of claim 50 wherein the television broadcast and the set of files are presented on a same screen.

89. The method of claim 50 wherein the television broadcast and the set of files are presented on different screens.

90. The method of claim 50 wherein electronics receiving and displaying the television broadcast on a first screen coupled to a game server via the Internet provide control information to a second screen.
