Abstract

A method of and system for handling latency issues encountered in producing real-time entertainment such as games of skill synchronized with live or taped televised events is described herein. There are multiple situations that are dealt with regarding latencies in receiving a television signal with respect to real-time entertainment based on the unfolding games played along with the telecasts. Systemic delays, arbitrarily imposed delays of a broadcast signal and variances in the precise broadcast times of taped television programs have to be equalized so as to provide fair entertainment.

Claims (58)

1. A device for equalizing effects of latency issues for a game of skill or chance or other entertainment played in conjunction with content comprising:

a storage device; and

an application contained within the storage device for sending a lockout signal based on a predetermined amount of delay in receipt of the content to prevent a user from submitting a selection after an outcome of a future event in the content is known.

2. The device of claim 1 wherein the content comprises information or entertainment content.

3. The device of claim 1 wherein the content comprises streamed video.

4. The device of claim 1 wherein the application includes a location application for determining the location of one or more Internet-connected devices.

5. The device of claim 1 wherein the amount of delay accounts for delays within a transmission path.

6. The device of claim 1 wherein the game of skill or chance or other entertainment is synchronized with the content.

7. The device of claim 6 wherein synchronizing utilizes a start signal generated by a game producer.

8. The device of claim 6 wherein synchronizing comprises sending a signal from a game server at a predetermined time.

9. The device of claim 6 wherein existing events in the content are used as synchronization points as start points for downloaded data files.

10. The device of claim 6 wherein a synchronization point is a visible or audible event located within the content.

11. The device of claim 6 wherein information is embedded in the content invisible to the user and tracked online in real-time.

12. The device of claim 6 wherein measured delays in various transmission paths are utilized to trigger transmission of lockout signals.

13. The device of claim 5 further comprising determining one or more start times in the content including using a signal recognizable by the device.

14. The device of claim 1 wherein the application is further for delivering a start time of a television commercial using a recognizable signal recognizable by the device.

15. The device of claim 1 wherein the game of skill or chance or other entertainment comprises pre-produced data files.

16. The device of claim 15 wherein the pre-produced data files comprise real-time entertainment.

17. The device of claim 15 wherein a plurality of synchronization points are used by a client to continuously check to ensure the pre-produced data files are synchronized with the content.

18. The device of claim 15 wherein inserted audio or video is used to continuously check to ensure the pre-produced data files are precisely synchronized on a client with the content.

19. The device of claim 18 wherein the inserted audio or video is used by a client to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the content.

20. The device of claim 18 wherein the inserted audio or video is used by a server to continuously check to ensure the pre-produced data files are precisely synchronized on the client with the content.

21. The device of claim 6 wherein an artifact is inserted into the content recognizable by an audio receiver in the device which is utilized to start and continually keep a game of skill or chance or other entertainment synchronized with the content.

22. The device of claim 1 wherein the game of skill or chance or other entertainment ends when the content ends.

23. The device of claim 1 wherein a server sends the game of skill or chance or other entertainment to the device.

24. The device of claim 1 wherein the game of skill or chance or other entertainment is stored in a memory of the device.

25. The device of claim 1 wherein the game of skill or chance or other entertainment is stored in random access memory of the device.

26. The device of claim 1 wherein the application is further for displaying the game of skill or chance or other entertainment on the device.

27. The device of claim 1 wherein an earliest receipt of the lockout signal by participants is utilized for equalizing locking out all participants receiving the content.

28. The device of claim 1 wherein the application is further for establishing the amount of delay by comparing audio or video samples derived from the device linked to a game server by comparing samples to archived audio or video files of the content.

29. The device of claim 28 wherein adjustment of the amount of delay results in synchronization of receipt of a signal of the content and presentation of game-related data on the device.

30. The device of claim 1 wherein the application is further for determining a shortest delay of participants and applying lockouts to the participants based on the shortest delay.

31. The device of claim 1 wherein participants comprise ad hoc or preexisting groups of friends competing in a separate competition in disparate physical locations.

32. The device of claim 6 wherein synchronization points are the audio or video data for the content residing on a server online with the device.

33. The device of claim 1 wherein participants constitute ad hoc or existing groups of geographically dispersed friends participating in a separate game of chance or skill or other entertainment.

34. The device of claim 33 wherein the participants are ad hoc or previously organized groups of friends competing against each other in a separate contest.

35. The device of claim 34 wherein equalizing the participants comprises time stamping an amount of delay on game-related data.

36. The device of claim 1 wherein the application is further for establishing the amount of delay through an automated system which samples an audio or video track of a satellite, cable or over the air broadcast television signal, linked to a game server, to provide information related to a precise arrival of an underlying television picture.

37. The device of claim 1 wherein the content is stored on a digital video recorder.

38. The device of claim 1 wherein the application is further for determining if there is additional processing of the content increasing a total length of the delay.

39. The device of claim 1 wherein the delay includes a digital video recorder delay wherein the content is recorded on the digital video recorder.

40. The device of claim 1 wherein the application is further for equalizing the delay wherein equalizing incorporates time stamping the amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time where client software delays presentation of game data based on a precise time of reception of the content.

41. The device of claim 1 wherein the content is a time shifted telecast and wherein a client used in connection with viewing the time shifted telecast of a previously recorded program utilizes automatic content recognition to synchronize preproduced game data files to precisely synchronize the preproduced game data files with the recorded telecast.

The device of claim 1 wherein the content is a time shifted telecast and wherein a client used in connection with viewing a delayed program utilizes automatic content recognition to synchronize preproduced game data files to precisely synchronize the preproduced game data files with the recorded telecast.

The device of claim 1 wherein the application is further for establishing the amount of delay through an automated system which samples an audio track of a satellite, cable or over the air broadcast signal, linked to a game server, to provide information related to a precise arrival of the content.

The device of claim 1 wherein the application is further for equalizing a set of cohorts comprising time stamping the amount of delay on a game lock out signal, imposing the amount of delay on an entire game data stream and sending game control data to the participant cohorts at the same time relative to receipt of the content, where client software delays presentation of game data based on a precise time of reception of the content by a group.

45. The device of claim 1 wherein the content and the application are presented on a same screen.

46. The device of claim 1 wherein the content and the application are presented on different screens.

47. The device of claim 1 further comprising electronics for receiving and displaying the content on a first screen and providing control information to a second screen.

48. The device of claim 1 wherein sending the lockout signal includes preventing a user from submitting the selection after the correct answer has been revealed.

49. The device of claim 1 wherein the content is a broadcast, satellite or cable telecast.

50. The device of claim 1 further comprising determining one or more start times in the content based on visual observation of events located within the content.

51. The device of claim 50 wherein the visual observation includes a sports-related action.

52. The device of claim 10 wherein the visible event includes a sports-related action.

53. The device of claim 1 wherein the application is further for establishing the amount of delay by comparing audio or video samples derived from the device linked to a remote audio or video broadcast transmission with the receipt of the content.

54. The device of claim 1 wherein the device comprises a mobile device.

55. The device of claim 54 wherein the mobile device comprises a cellular phone.

56. The device of claim 1 wherein the device comprises a server.
