Abstract

Systems and methods for intellectual property (IP) asset protection are disclosed. For example, by analyzing characteristic information associated with a user, along with feedback from one or more potential insurers, the system may determine various terms of an insurance policy for protecting the user against claims of IP infringement. The policy may provide for financial reimbursement for costs incurred while taking active measures to mitigate losses and/or defend against such claims. In addition, the system may analyze the characteristic information to identify various users having a low exposure of an infringement claim being asserted. The identified users may be actively targeted to acquire an IP protection policy.

Claims (125)

1. A method, comprising:

receiving a request for an insurance quote to insure an entity against a claim of intellectual property infringement;

in response to receiving the request, generating request data for information indicating a characteristic of the entity, the request data based at least in part on the entity associated with the request;

receiving, via a user interface caused to be displayed on a device associated with the entity and in response to the request data, information indicating characteristics of the entity, the information including at least one of:

business information;

intellectual property information; or

legal claim information;

generating, based at least in part on the information, characteristic data associated with the characteristics of the entity;

generating a machine learning model configured to determine infringement exposure values associated with entities;

generating a training dataset including historical user data and historical policy performance metrics;

training the machine learning model utilizing the training dataset such that a trained machine learning model is generated to weight the characteristics of entities in a way that differs from analysis of the characteristics using the machine learning model prior to training;

determining, based at least in part on the characteristic data and utilizing the trained machine learning model, an infringement exposure value associated with the entity, wherein determining the infringement exposure value includes at least:

analyzing a first characteristic of the characteristics, the first characteristic indicating a revenue source of the entity; and

analyzing a second characteristic of the characteristics, the second characteristic indicating a correlation between an intellectual property asset of the entity and the revenue source;

causing display of the infringement exposure value on the user interface along with a user input element configured to receive user input associated with the infringement exposure value;

generating, based at least in part on user input received at the user input element, feedback data associated with the infringement exposure value;

determining, based at least in part on the infringement exposure value and the feedback data, at least one term of an insurance policy associated with the entity;

automatically generating policy data representing the insurance policy including the at least one term, the automatic generation of the policy data based at least in part on the characteristic data, the infringement exposure value, and the feedback data, and the automatic generation of the policy data performed absent user input and utilizing prior policy data generated in association with a prior insurance policy; and

sending the policy data to the device, the policy data causing the device to display the insurance policy along with functionality for accepting the insurance policy.

2. The method of claim 1 , wherein determining the infringement exposure value comprises determining the infringement exposure value based at least in part on a revenue source associated with the entity.

3. The method of claim 1 , wherein:

the business information includes at least an industry classification, a number of employees, or a revenue value;

the intellectual property information includes at least one of:

a number of intellectual property assets associated with the entity;

a type of intellectual property of individual ones of the intellectual property assets;

a licensing agreement associated with at least one of the intellectual property assets; or

a second insurance policy associated with the at least one of the intellectual property assets; and

the legal claim information includes at least one of:

a litigation history associated with the entity;

information associated with infringement allegations asserted against the entity; or

resolution information including at least one of settlement terms, damages, or information indicating whether the entity prevailed.

4. The method of claim 1 , wherein the at least one term of the insurance policy includes at least one of:

a reimbursement provision covering a cost associated with defending against the claim of intellectual property infringement;

a settlement cost;

a damages cost;

legal costs; or

an indemnity cost.

5. The method of claim 1 , wherein:

receiving the information indicating the characteristic of the entity comprises:

accessing one or more databases having first data associated with the entity;

identifying a given characteristic for which second data is unavailable in the one or more databases;

sending, based at least in part on identifying the given characteristic, an intake document including an element requesting the second data; and

receiving the second data; and

determining the characteristic data comprises determining the characteristic data based at least in part on the second data.

6. A method comprising:

generating request data for information indicating a characteristic of an entity, the request data based at least in part on the entity associated with a request for an insurance product related to a claim of intellectual property infringement;

receiving the information via a user interface caused to be displayed on a device associated with the entity;

determining characteristic data associated with the entity based at least in part on the information, wherein the characteristic data includes at least one of:

business information;

intellectual property information; or

legal claim information;

generating a machine learning model configured to determine infringement exposure values associated with entities;

generating a training dataset including historical user data and historical policy performance metrics;

training the machine learning model utilizing the training dataset such that a trained machine learning model is generated to weight the characteristics of entities in a way that differs from analysis of the characteristics using the machine learning model prior to training;

determining, based at least in part on the characteristic data and utilizing the trained machine learning model, an infringement exposure value associated with the entity, wherein determining the infringement exposure value includes at least:

analyzing a first characteristic of the characteristics, the first characteristic indicating a revenue source of the entity; and

analyzing a second characteristic of the characteristics, the second characteristic indicating a correlation between an intellectual property asset of the entity and the revenue source;

generating feedback data associated with the infringement exposure value, the feedback data based at least in part on user input received from the user interface;

determining, based at least in part on the infringement exposure value and the feedback data, at least one term of an insurance policy associated with the entity;

automatically generating policy data representing the insurance policy including the at least one term, the automatic generation of the policy data based at least in part on the characteristic data, the infringement exposure value, and the feedback data, and the automatic generation of the policy data performed absent user input and utilizing prior policy data generated in association with a prior insurance policy; and

sending the policy data to the device, the policy data causing the device to display the insurance policy along with functionality for accepting the insurance policy.

7. The method of claim 6 , wherein the user input is associated with at least one of the business information, the intellectual property information, or the legal claim information.

8. The method of claim 7 , wherein:

the business information includes at least an industry classification, a number of employees, or a revenue value;

the intellectual property information includes at least one of:

a number of intellectual property assets associated with the entity;

a type of intellectual property of individual ones of the intellectual property assets;

a licensing agreement associated with at least one of the intellectual property assets; or

a second insurance policy associated with the at least one of the intellectual property assets; and

the legal claim information includes at least one of:

a litigation history associated with the entity;

information associated with infringement allegations asserted against the entity; or

resolution information, the resolution information including at least one of settlement terms, damages, or whether the entity prevailed.

9. The method of claim 8 , further comprising:

receiving, from at least one of a device associated with an insurer or at least one insurer, data associated with the infringement exposure value; and

wherein determining the at least one term comprises determining the at least one term based at least in part on the data.

10. The method of claim 9 , further comprising:

receiving a first indication of acceptance of the insurance policy by the entity;

receiving a second indication of acceptance of the insurance policy by the insurer; and

in response to receiving the first indication and the second indication, issuing the insurance policy.

11. The method of claim 6 , wherein the at least one term of the insurance policy includes at least one of:

a reimbursement provision covering a cost associated with defending against a claim of intellectual property infringement;

a settlement cost;

a damages cost;

legal cost; or

an indemnity cost.

12. A method comprising:

generating a machine learning model configured to determine infringement exposure values associated with entities;

generating a training dataset including historical user data and historical policy performance metrics;

training the machine learning model utilizing the training dataset such that a trained machine learning model is generated to weight characteristics of entities in a way that differs from analysis of the characteristics using the machine learning model prior to training;

analyzing characteristic data associated with one or more entities to determine, utilizing the trained machine learning model, one or more exposure values associated with individual entities of the one or more entities, the one or more exposure values associated with a claim of intellectual property infringement, wherein determining the infringement exposure values includes at least:

analyzing a first characteristic indicating revenue sources of the one or more entities; and

analyzing a second characteristic indicating a correlation between a given intellectual property asset and the revenue sources;

identifying, based at least in part on the one or more exposure values, an entity of the one or more entities having an exposure value below an exposure value threshold;

automatically generating policy data representing the insurance policy including the at least one term, the automatic generation of the policy data based at least in part on the characteristic data, the infringement exposure value, and the feedback data, and the automatic generation of the policy data performed absent user input and utilizing prior policy data generated in association with a prior insurance policy; and

determining, based at least in part on the exposure value, an insurance policy indication associated with the entity; and

causing the device associated with the entity to display the insurance policy indication along with an element for accepting the insurance policy associated with the insurance policy indication.

13. The method of claim 12 , further comprising:

receiving first information associated with a characteristic of the one or more entities, the data including at least one of:

business information;

intellectual property information; or

legal claim information; and

generating, based at least in part on the information, characteristic data associated with the characteristic of the one or more entities.

14. The method of claim 13 , wherein the insurance policy indication requests second information associated with the characteristic data.

15. The method of claim 14 , further comprising:

receiving the input data associated with the second information; and

wherein determining the insurance policy indication is based at least in part on the input data.

16. The method of claim 15 , further comprising:

analyzing the second information to determine additional characteristic data associated with the characteristic;

analyzing the characteristic data and the additional characteristic data to determine an additional exposure value associated with the entity; and

determining, based at least in part on the additional exposure value, a term of the insurance policy.

17. The method of claim 15 , further comprising:

receiving, from at least one of a device associated with an insurer or the insurer, feedback data associated with the additional exposure value; and

wherein determining the insurance policy indication is based at least in part on the feedback data.

18. The method of claim 12 , further comprising:

receiving a first indication of acceptance of the insurance policy by the entity;

receiving a second indication of acceptance of the insurance policy by the insurer; and

in response to receiving the first indication and the second indication, issuing the insurance policy.

19. The method of claim 12 , wherein the characteristic data includes:

business information including at least an industry classification, a number of employees, or a revenue value; and

intellectual property information including at least one of:

a number of intellectual property assets associated with the entity;

a type of intellectual property of individual ones of the intellectual property assets;

a licensing agreement associated with at least one of the intellectual property assets; or

a second insurance policy associated with the at least one of the intellectual property assets.
